Traffic Laws and Violations in Galax
Traffic violations in the City of Galax follow Virginia state law. The most serious common charge is reckless driving, which is a Class 1 misdemeanor under Virginia Code § 46.2-852. Unlike a simple speeding ticket, a reckless driving conviction goes on your criminal record. It is not just a traffic infraction. Virginia handles reckless driving more like a criminal offense than most other states do.
Speed is one of the main triggers for reckless driving charges in Virginia. Under Virginia Code § 46.2-862, driving 20 mph or more over the posted limit counts as reckless driving. Going over 85 mph anywhere in the state is also reckless driving regardless of the speed limit. On many two-lane roads in the Galax area, the speed limits are lower than on highways, so that 20 mph threshold can be reached sooner than people expect.
Standard speeding tickets below the reckless driving threshold are traffic infractions. They add demerit points to your Virginia DMV record and require payment of fines, but they are not criminal charges. You must also contact the Virginia DMV to restore your driving privileges after the fine is cleared.
